12/08/2020: Fairway Customers Receiving Stale Dated Check Letters

Fairway mailed approximately 2,600 letters to customers regarding refund checks issued that remain outstanding (not cashed or deposited).  This letter advises customers that Fairway is required to remit these outstanding funds to the State where they reside if a request to stop pay and reissue the refund check is not received by the date specified in the letter.  

The verbiage contained in the letter is shown below:

Dear Customer Name,

Our records indicate that Fairway Independent Mortgage Corporation “FIMC” issued a check to you within the last 60 days and this check is still outstanding. The details of this check include the following:

                Loan Number:

                Check Number:

                Check Amount:

State law requires we turn these funds over to the state of (Enter State) as unclaimed property if we do not receive your response by (enter date). If you are in possession of   this check, please shred and discard this check at your earliest convenience. If this check has been lost or destroyed and you need the check reissued, please attest to the statement below by signing, dating, and returning this letter to FIMC as soon as possible.

                Please issue a new check for the payment referenced above. I have not attempted

to fund the previously distributed check and will not attempt to do so going forward. 

If I find the check referenced above, I will return it to Fairway Independent Mortgage Corporation immediately. I certify that I am entitled to the funds.

Escrow Department

This letter instructs customers to sign and return the letter provided but does not clearly reference a specific address to return this letter to Fairway.  This is causing confusion for customers.

Please advise the following:

  • This is a valid letter from Fairway regarding a refund check sent to the customer but not yet cashed or deposited
  • The customer must sign and return the letter to Fairway prior to the date referenced or the funds will be turned over to the State where they reside
  • This letter may be returned by mail to either Fairway Carrollton Corporate Office or a scanned signed copy may be sent by email to servicing@fairwaymc.com
  • Mailrooms at each office are aware of this letter and will ensure it is routed to the proper department and person for handling
